Legal Notice

§1 Introduction

This Legal Notice (hereinafter: "Legal Notice") sets out the rules regarding the protection of materials on the online store balter.com.pl and the prohibition of copying products and using Balter Sp. z o.o.'s know-how, headquartered in Warsaw. This Legal Notice is published on the website balter.pl.

§2 Definitions of terms used in the Legal Notice

"Balter" – Balter Sp. z o.o. with its registered office in Warsaw, ul. Aleje Jerozolimskie 85 / 11, 02-001 Warsaw, entered into the register of entrepreneurs of the National Court Register under KRS number: 0000937231, REGON: 520629570, NIP: 1133046792.
"Customer" – a natural person, legal entity, or organizational unit not being a legal person, which under specific regulations has legal capacity, and who places an Order through the Store.
"Civil Code" – the Act of April 23, 1964, the Civil Code.
"Store" or "Online Store" – the online shop along with the informational portal available at balter.com.pl, through which the Customer can, in particular, place Orders.
"Regulations" – the rules of operation of the Online Store balter.com.pl, published at balter.com.pl/regulamin/
"Goods" (or singular "Product") – products presented and sold in the Store; i.e., clothing shown on the website, as well as other products available in the Store, which are accessible and prepared without individual orders.
"Contract" or "Sales Contract" – a sales agreement for the Goods within the meaning of the Civil Code, concluded between Balter and the Customer, during the use of the Store.
"Copyright Law" – the Act of February 4, 1994, on copyright and related rights;
"Order" – the Customer's declaration of will aimed directly at concluding a Sales Contract, specifying in particular the type and quantity of Goods.

§4 Protection of materials in the online store balter.com.pl

Materials placed in the Online Store (hereinafter: "Materials") are protected by the provisions of the Copyright Law.
The owner of the copyright copyrights to the Materials is Balter Sp. z o.o., with its registered office in Warsaw, ul. Aleje Jerozolimskie 85 / 11, 02-001 Warsaw, entered into the register of entrepreneurs of the National Court Register under KRS: 0000937231, REGON: 520629570, NIP: 1133046792.
It is forbidden, among other things, to copy, modify, and distribute the Materials published in the Online Store, especially data regarding Balter products or their elements, including photographs, graphics, banners, trademarks, texts, etc., as well as to place Materials or their parts on any internet service or server, under threat of legal sanctions.

§5 Prohibition of copying Goods and using Balter's know-how

Balter is the owner of the online store and the manufacturer of the Goods. Know-how – related to the production of Goods, architectural and technical designs, product design, packaging, industrial patterns, trademarks, patents, trade secrets of Balter, is the property of Balter and protected by law, including copyright, other intellectual property rights, or proprietary rights.
Balter reserves all rights to the Goods and their appearance.
By concluding the Contract, Balter does not grant the Customer the right to copy or reproduce the Goods.
It is prohibited to copy, reproduce, distribute, create derivative works, or use the Goods in any way.
It is forbidden to copy the external appearance of the Goods or imitate them through technical reproduction means.
It is forbidden to copy functional features of the Goods, particularly their construction, design, and shape that ensure their utility.
Each pattern, graphic design, texture, print, or decorative element related to the Goods constitutes a Work within the meaning of the Copyright Law and is subject to legal protection under this law.
The Customer does not have the right to use for their own purposes, copy, reproduce, publish, distribute, transfer, display, exhibit, edit, modify, create derivative works, or in any way exploit elements of clothing, products, or patterns of Balter, including copying patterns, solutions, techniques, design of Balter, etc.The Customer is not authorized to manufacture Goods independently, through affiliated entities or third parties, that are similar to the Goods, particularly Goods whose production was based on Know-how — Balter’s know-how, copying patterns, solutions, techniques, Balter’s design, etc.
Copying Goods will be considered an act of unfair competition.
Sanctions for violating the provisions of this §3 are specified in the Regulations.
For violations of this §3 by the Customer, Balter has the right to pursue contractual penalties in accordance with the Regulations and seek compensation for damages caused to Balter by the infringing entity.

§6 Final Provisions

Customers can access this Legal Notice at any time via the link provided on the main page of the balter.com.pl website.
The content of this Legal Notice can be preserved by printing, saving, or downloading at any time from the balter.com.pl website.
The Seller may change this Legal Notice. Any change to the Legal Notice becomes effective at the appropriate time indicated by the Seller, counted from the day the new version of the Legal Notice is made available, provided that sale agreements concluded before the amendments come into force continue to be governed by the previous rules.
